A transgender music teacher in North Carolina has become the center of a threatened federal lawsuit. But beneath the language about parental rights, religious freedom and classroom instruction sits a much more uncomfortable question.
Can simply being transgender be something children are allowed to “opt out” of?
The Thomas More Society sent a demand letter Sept. 15 to the Wake County Public School System on behalf of parents at Middle Creek Elementary School in Apex. The conservative legal organization gave the district 15 days to meet several demands or potentially face a lawsuit.
Among those demands: parents must be allowed to remove children from the transgender teacher’s music class, students cannot be disciplined for refusing to use her pronouns, and the teacher must not share restrooms, locker rooms, or similar spaces with students. The group also wants restrictions on discussions of gender identity and sexuality.
There is one rather important detail getting buried underneath all of that.
There have been no reported allegations that the teacher has behaved improperly in the classroom.
Wake parent Amanda Paolini pointed that out during a recent school board meeting, noting that despite weeks of petitions, media coverage, and public controversy, nobody had alleged an actual act of misconduct by the teacher.
That distinction matters.
This isn’t a controversy that began because a teacher introduced inappropriate material into music class. It began because the teacher is transgender.
Some parents argue that requiring their children to attend her class conflicts with their religious beliefs. The Thomas More Society says recent court decisions protecting parental religious rights support their position. The organization specifically cites cases, including the Supreme Court’s 2025 Mahmoud v. Taylor decision.
But Mahmoud concerned LGBTQ-inclusive instructional materials. Here, the objection extends to the identity of the person standing at the front of the classroom.
That’s a significant difference.
North Carolina law already restricts instruction about gender identity and sexuality in kindergarten through fourth grade. Meanwhile, Wake County’s employment policies prohibit discrimination based on gender identity.
So what exactly are families being asked to opt out of?
By the available reporting, it isn’t transgender curriculum.
It’s a transgender person.
The controversy also didn’t remain inside Middle Creek for long. Republican state Rep. Erin Paré publicly criticized the hiring over the summer, and conservative websites and social media accounts subsequently circulated the teacher’s name and photograph. The dispute has since attracted national attention.
Other parents have defended the teacher, arguing that her qualifications and classroom performance should matter more than her gender identity. Some say their children have had no problem with her.
For transgender Americans, that’s what makes this story bigger than one elementary school. The question isn’t simply whether parents should have rights over their children’s education. Of course they do.
The question potentially heading toward a courtroom is whether those rights include insulating children from encountering a transgender person doing an ordinary job.
Because transgender people aren’t in the curriculum. We’re teachers, nurses, construction workers, accountants, neighbors, and parents. And existing in the same room as someone else’s child shouldn’t require an opt-out form.
