HHS Retreats on Hospital Funding Threat After Public Backlash

Following widespread public opposition, HHS has abandoned a proposal that would have stripped Medicare and Medicaid funding from hospitals providing gender-affirming care to transgender youth. Advocates welcomed the decision but warn that other federal restrictions and state-level bans continue to threaten access to care.

The U.S. Department of Health and Human Services (HHS) has backed away from one of the most sweeping proposals targeting transgender health care after intense public pressure, advocacy from LGBTQ+ organizations, and widespread concern from hospitals across the country. While the administration continues to pursue restrictions on gender-affirming care for transgender youth, a controversial plan that would have jeopardized federal funding for entire hospitals has been shelved, for now.

According to reporting by NPR, the Trump administration had been preparing a regulation that would have denied Medicare and Medicaid funding to any hospital providing gender-affirming medical care to patients under 19. The proposal alarmed health care systems because it threatened not just transgender-related services, but potentially billions of dollars in federal reimbursements that support emergency rooms, cancer treatment, maternity care, and countless other essential medical services.

Under the draft proposal, hospitals could have been forced to choose between continuing medically necessary care for transgender adolescents or risking the loss of critical federal funding. Health care leaders warned that such a policy would have consequences extending far beyond transgender patients.

However, after thousands of public comments and mounting criticism from civil rights organizations, medical professionals, and hospital systems, HHS has reportedly abandoned that portion of the proposal. While the agency is still pursuing rules affecting Medicaid and Children’s Health Insurance Program (CHIP) reimbursement for gender-affirming care, the broader threat against entire hospitals is no longer moving forward.

The Human Rights Campaign called the decision an important victory for transgender youth and their families. The organization credited public opposition with forcing the administration to reverse course, noting that hospitals across the country had faced enormous uncertainty over whether they could continue providing comprehensive medical care while maintaining federal funding.

“This happened because people spoke out,” HRC said in its response, while cautioning that significant threats to transgender health care remain.

The policy reversal does not restore access to care in states that have already enacted bans on gender-affirming treatment for minors. More than half of U.S. states currently have laws or policies restricting such care, and numerous legal challenges remain active in federal courts.

The administration also continues advancing other measures aimed at limiting access to gender-affirming care through federal insurance programs. Those proposals could still affect Medicaid and CHIP reimbursement for treatment provided to transgender youth, even without the broader hospital funding penalty.

For transgender families and health care providers, the HHS decision offers a temporary reprieve rather than a permanent resolution. Hospitals no longer face the immediate prospect of losing all Medicare and Medicaid funding simply for treating transgender adolescents, but the broader legal and political battle over access to gender-affirming care continues.

Advocates say the episode demonstrates both the vulnerability of transgender health care under shifting federal policies and the impact that coordinated public advocacy can have on the policymaking process. As additional federal rules and court cases move forward, access to care for transgender youth remains one of the nation’s most closely watched civil rights issues.
