Pentagon, Scouting America Face Lawsuit Over Trans Policy

A federal lawsuit is seeking the release of a confidential agreement between the Pentagon and Scouting America after Defense Secretary Pete Hegseth claimed the organization agreed to recognize members by biological sex, while Scouting America insists its transgender-inclusive membership policy remains unchanged. The case could determine whether federal pressure influenced the organization's policies.

A new federal lawsuit is raising questions about whether Scouting America quietly agreed to restrict transgender participation in exchange for maintaining its longstanding relationship with the U.S. military.

The complaint, filed Thursday in federal court by gay rights activist James Dale, seeks to force the Department of Defense to release its agreement with Scouting America after months of conflicting public statements from the organization and Pentagon officials. At the heart of the dispute is a simple but significant question: Did Scouting America actually agree to exclude transgender members, or did the Pentagon misrepresent the deal?

The controversy began in February when Defense Secretary Pete Hegseth announced that the Pentagon had reached an agreement with Scouting America, formerly the Boy Scouts of America. Hegseth said the organization would move away from diversity initiatives and require members to be recognized according to their biological sex at birth rather than their gender identity. He also warned that military support for the organization could end if the changes were not implemented within six months.

Scouting America quickly pushed back on that interpretation.

At the time, the organization stated that its membership policies regarding transgender youth had not changed and that transgender members remained welcome. Scouting America President and CEO Roger Krone publicly reaffirmed that commitment, saying the organization would continue serving transgender youth just as it had before. The group’s published membership policy also continues to state that it welcomes eligible youth regardless of gender or orientation.

Unable to reconcile those opposing claims, Dale filed a Freedom of Information Act request in March seeking a copy of the memorandum of understanding between the Pentagon and Scouting America. According to the lawsuit, the Defense Department failed to produce the document or cite any legal exemption allowing it to withhold the agreement. Dale’s new legal complaint argues that the public deserves transparency before the Pentagon’s August compliance deadline expires.

Dale is no stranger to Scouting America. In 1990, he was expelled from the Boy Scouts after the organization learned he was openly gay. His lawsuit eventually reached the U.S. Supreme Court, which ruled in 2000 that the private organization had the constitutional right to establish its own membership standards.

His latest filing raises a different constitutional concern. If the Pentagon effectively required Scouting America to change its membership policies through a government contract, Dale argues that the federal government may have accomplished indirectly what it could not require directly through law. If Scouting America is correct that no such changes were made, then the lawsuit contends the Pentagon has misled the public about the agreement’s contents.

For transgender families, the uncertainty creates confusion about whether current policies remain in place and whether future participation could be affected by federal pressure. Until the agreement is released, or a court orders its disclosure, the public is left with two competing narratives that cannot both be true.

The Pentagon has declined to comment on the pending litigation, while Scouting America has not issued a new statement regarding the lawsuit. As the August deadline approaches, the court’s decision on whether the agreement must be made public could provide long-awaited answers for transgender scouts, their families, and the broader public.
